AGREEMENT REACHED ON BREWERIES BILL
The Beer Distributors and the Massachusetts Brewers Guild (representing the craft breweries) have reached an AGREEMENT on a bill, S. 2841, that addresses the long-standing dispute over beer distribution relationships.
This agreement resolves our 10-year dispute over beer distribution relationships. The agreement allows qualified breweries to terminate beer distributors selling brands and products of malt beverages at any time, for no reason. A “Qualified Brewery” may produce less than 250,000 barrels (or 3,445,000 cases) of beer within the preceding 12 months. This agreement strikes the right balance.
The bill, S. 2841, was passed by the State Senate Thursday, July 23rd. It is pending before the House of Representatives.
William Kelley, President of The Beer Distributors of Massachusetts (BDM), today issued a statement thanking Governor Baker for signing the agreed bill, An Act Relative to Craft Brewers. The Act is effective immediately.

The 21st Amendment to the U.S. Constitution gives states the primary responsibility to regulate alcohol. State fair trade laws are a key component of state alcohol regulations; they address the relationship between beer suppliers and distributors. Beer fair trade laws provide balance and guidance for brewers and beer distributors.
